If you are already in the United States and fear persecution in your home country based on race, religion, nationality, political opinion, or membership in a particular social group, you may file an affirmative asylum application with USCIS. Applications must generally be filed within one year of your last arrival in the U.S., with limited exceptions.
To apply for a green card, you generally need a qualifying basis such as a family relationship, employer sponsorship, investment, or humanitarian relief. A sponsor files a petition (such as Form I-130 or I-140), and once it is approved and a visa is available you file Form I-485 or apply through a U.S. consulate abroad.
Most green card holders can apply for naturalization after five years of permanent residence, or three years if married to a U.S. citizen. After filing Form N-400, the process — including biometrics, the interview, the civics test, and the oath ceremony — typically takes about 8 to 14 months depending on your local USCIS field office.
A Notice to Appear (NTA) means the government has started removal proceedings against you. Do not ignore it. Note your hearing date, do not miss court, and contact an immigration attorney immediately. A lawyer can review the charges, identify relief such as cancellation of removal or asylum, and represent you before the immigration judge.
A green card grants lawful permanent residence: you can live and work in the U.S. but must renew the card, can lose status through long absences, and cannot vote. U.S. citizenship is permanent — it allows voting, a U.S. passport, broader family sponsorship, and protection from deportation, and is usually obtained through naturalization.
